Terms of Service
Article 1 (Purpose)
These Terms of Service ("Terms") govern the rights, obligations, responsibilities, and other necessary matters between FASTRACTIVE ("Company") and users in connection with the use of the FANESIS service ("Service").
Article 2 (Definitions)
The terms used in these Terms are defined as follows. ① "Service" means the FANESIS application and all related ancillary services provided by the Company. ② "User" means an individual who agrees to these Terms and uses the Service. ③ "Account" means the combination of ID and password a User sets up to access the Service. ④ "Content" means all materials such as text, images, and data created, uploaded, or stored by a User within the Service.
Article 3 (Effectiveness and Modification of Terms)
① These Terms apply to all users who wish to use the Service. ② The Company may amend these Terms within the scope permitted by applicable law, providing at least 7 days' prior notice via in-app announcements or email. ③ If a User disagrees with the amended Terms, the User may stop using the Service and delete their account. ④ If a User does not express refusal within 7 days after the notice, the User is deemed to have agreed to the amended Terms.
Article 4 (Eligibility)
① The Service is available to users worldwide. ② Minors under 14 years of age (under 13 in the United States) may not use the Service without consent from a legal guardian. ③ The Company may restrict Service availability in certain countries or regions in compliance with local laws. ④ By agreeing to these Terms, Users confirm that they have the legal capacity required to use the Service.
Article 5 (Account Creation and Management)
① Users may register for the Service via social login using a Google or Apple account. ② Users are obligated to provide accurate and current information; accounts with false information may be deleted. ③ Accounts and passwords are for the User's exclusive use and may not be transferred or shared with others. ④ If a User suspects a security breach of their account, they must immediately report it to the Company. ⑤ Each User may hold only one account.
Article 6 (Service Provision)
① The Company provides the FANESIS Service 24 hours a day, 365 days a year as a general rule. ② The Company may temporarily suspend the Service when operationally or technically necessary, with prior or subsequent notice. ③ The Company may change the content, features, or methods of the Service; material changes will be announced in advance. ④ Some features of the Service may be offered on a paid basis, with a separate consent process required before use.
Article 7 (User Obligations)
Users must not engage in any of the following acts: ① Collecting, storing, or disclosing others' personal information without authorization ② Interfering with the normal operation of the Service (e.g., hacking, distributing viruses) ③ Infringing on the intellectual property rights of the Company or third parties ④ Spreading false information or deceiving others ⑤ Uploading or sharing illegal or inappropriate content ⑥ Violating applicable laws or these Terms
Article 8 (Content and Intellectual Property)
① Copyright and other intellectual property rights in content created by a User within the Service vest in that User. ② By posting content on the Service, the User grants the Company the right to use, reproduce, and process such content solely for the purpose of providing the Service. ③ Intellectual property rights in the Service itself, including its design, software, and brand, vest in the Company. ④ Users may not copy, distribute, or modify any part of the Service without the Company's prior written consent.
Article 9 (Personal Information Protection)
The Company collects, uses, and manages users' personal information in accordance with the Privacy Policy. The Privacy Policy is available within the Service.
Article 10 (Disclaimer)
① The Company is not liable for failure to provide the Service due to force majeure events such as natural disasters, war, or government regulations. ② The Company is not liable for Service disruptions caused by the User's own fault. ③ The Company does not guarantee any profits or outcomes expected by the User through the Service. ④ The Service is provided "AS IS," and the Company makes no express or implied warranties regarding the completeness, accuracy, or reliability of the Service. ⑤ To the maximum extent permitted by law, the Company's total liability shall not exceed the amount paid by the User in the most recent 6 months.
Article 11 (Account Termination and Service Discontinuation)
① Users may delete their account and stop using the Service at any time through the Settings menu. ② The Company may suspend or delete an account with prior notice if the User violates these Terms. ③ In cases of serious violations (criminal acts, significant harm to others, etc.), accounts may be immediately deleted without prior notice. ④ Upon account deletion, the User's content will be deleted except where retention is required by applicable law.
Article 12 (Governing Law and Dispute Resolution)
① These Terms shall be interpreted and applied in accordance with the laws of the Republic of Korea. ② EU users may be subject to EU consumer protection laws. ③ In the event of a dispute related to the use of the Service, the parties shall first attempt to resolve it through consultation. ④ If consultation is unsuccessful, the court having jurisdiction over the Company's registered location shall serve as the court of first instance.
